U.S. Copyright Law Covers Artistic Expression and Creative and Intellectual Works
The US Copyright Law grants rights to individuals for the works they create. The US Copyright Act of 1790 has changed over the years. The current basis of US copyright law is based on the Copyright Act of 1976. US copyright law is relatively automatic. Once someone has an idea and produces it in tangible form, the creator is the copyright holder and has the authority to enforce his exclusivity to it. In other words, the person is the owner of the creation. It is not necessary that a person register their work. However, it is recommended and it can serve as evidence if someone ever violates a copyright. It is interesting to note that when an employer hires an employee to produce a work that the copyright is given to the employer.
Violations of US Copyright Law are generally enforced in a civil court setting. However, there could also be criminal sanctions brought against someone who violates US copyright law. Someone that is in serious violation of US Copyright Law such as counterfeiting can find themselves on the inside of prison looking out. People need to understand that the copyright symbol is not a requirement. Someone may have a copyright, yet their work may not have a copyright notice or symbol.
US Copyright Law covers a wide range of things that are derived from artistic expression, intellectual or creative work. This includes things such as literary works, music, drawings, photographs, software, movies, choreographic works such as ballets and plays, poems, paintings and more. The law covers the form of expression, not the concept, facts or the actual idea of the work. This means that someone can use another person’s idea or concept and produce their own take on it. However, copying another person’s work is a violation. It should be noted that some things may not be copyrighted but they may be protected by a patent or trademark.
Individuals who have a copyright on a particular piece of work can do with it what they will. They may choose to copy it and sell it. They may display their work or perform it in public and charge admission, or they can assign or sell the work to someone else. Individuals who have a copyright can also choose to do nothing with their work, if that is their desire. However, if someone comes along and takes the work and tries to use it in some way, that person is still in violation of the owner’s copyright. Copyrights cover published and unpublished work.
Anyone who is in the creative arts arena should be very careful that they do not violate US Copyright Law. For that matter, anyone who is a fan of the creative arts should make sure they are not in violation of a copyright. Simple things like uploading, downloading and sharing music or movie files can result in serious charges and fines being brought against them. With the popularity of the Internet and file sharing software there many copyrights are currently being violated. Copyright owners are starting to take a stand against them and are hunting down the perpetrators. Be careful that you are not overstepping your boundaries and violating someone’s copyright law.
Is Christian Publishing the Easy Road to the World of Writing Success? (Christian publishing) Any community with a special interest will pay for products that cater to that special interest. If that community is of significant size, you can bet that there will be products galore geared to them. There is money to be made where there is a need for a product. The Christian community is one such group that has a desire for a very specific product. They are interested in products that explain their faith and expand their knowledge of what is less understood within that faith. They also seek encouragement in what is already agreed upon. Because of all of these needs, there is certainly a market to be entered into within the Christian publishing network. The question is, since the group is exclusive, does that mean that there are too few writers for the consumers? Is it easier to get published when you’re not competing with the best of the secular authors? Those are difficult questions to answer with any certainty, but there are some topics to explore within that subject. Degree of Expertise In one genre of Christian publishing one qualification is essential. To write with expertise on subjects of faith, it is necessary to have the correct education. A seminary degree at the very least is required for convincing publications. The publishers do not accept authoritative writing from those without the proper education. When it comes to education, separate Christian denominations will expect degrees endorsed from those specific denominations. You may have expected that a Christian would need to write for the Christian community, but the requirements can be much more stringent. Just as a pastor or preacher must have the proper education to teach a congregation, a writer on subjects of theology or other topics from the Bible must also have the credentials to back up his claims. While it is not possible for every writer to obtain the correct degree for authoritative writing, there are other kinds of writing that will easier to achieve within Christian publishing. Experiential Knowledge A huge portion of Christian publishing is made up of personal stories. A Christian has unique experiences related to his faith. People who seek encouragement will buy books that relate to their own circumstances. A typical human problem is grief. If a Christian can effectively write about their grief from a perspective of faith then those writings will be helpful to other struggling Christians. Other important subjects include doubt, blessings and prayer. A lay Christian can back up their experiences and observations with scripture and therefore be much more relevant in their writing to the Christian community. If the writer’s material is not sufficient to fill a book, there are other outlets within Christian publishing for those who are able to inform and encourage fellow Christians. Magazines and church bulletins often publish poetry and short stories for the building up of believers. The Bottom Line Christian publishing may not be necessarily easier to do than secular publishing. If your heart is in the ministry to other Christians however, it may be the best field for you to attempt writing for. Christian publishing is not a ‘first step’ to enter into the publishing world. Most publishers are only looking for sincere and relevant publications. They will avoid writings done only for the money and will favor those with the honest goal of furthering the message of the Christian faith. Specific communities are looking for products geared to their lifestyles, but the best candidates for creating those products are those who have talent invested in that community. Entering into the Christian publishing world will be a similar task to entering into the scientific publishing world. It will take dedication and work. The writer will come out with a deeper understanding and faith of his own. Working Smarter – Planting Seeds to Earn Employee of the Year To be awarded with the employee of the year and maybe even having your own plaque posted on the wall is the highest of rewards for some employees. With all the competition in the workplace, becoming the employee of the year is not an easy task. One of the first steps to becoming employee of the year is to be a good worker. Being a good worker actually includes lots of different strategies. A good worker is always on time and never leaves early without permission. Of great benefit to you as well as to others is to make sure that you have a pleasant attitude and lots of motivation. The lack of motivation in a workplace can slow down productivity immensely and if your boss sees that you are one major motivator in your department, a small seed towards that plaque is already planted. A good worker is also very well organized and works in an efficient manner. Efficiency with high quality results is a great combination to add more seeds to sprout your career and reach your goal of being the employee of the year. In some companies there is an employee awarded every month. The employee of the month gets awarded for his outstanding work and contribution to the company over the course of the month. Sometimes to become the employee of the year, you need to get several or the most of the employee of the month awards. But since you are trying to be the employee of the year, you must already try to be the best employee every month. You should have a chance for one or more of the monthly awards. Becoming employee of the months is one important seed to harvest your crop, the employee of the year award. Often times, it also helps to have a good relationship to your boss. A relationship of mutual respect, somebody your boss can rely on, likes to exchange ideas and just plain small talk with, are all important. Become his ally and best worker, but do not over do it. Sometimes in the effort to become employee of the year, you try too hard to be somebody you are not in order to show off in front of everybody and forget that working in a businesslike or industrial setting also means teamwork. Try to be a leader and show respect for others at your workplace. If you are just trying to take away work and glory from others, you will soon be the person nobody wants to go to. To become the employee of the year, you need to be a resource for others, help with their daily problems and most of all, respect them and recognize their accomplishments. If you are working in the team, everybody needs to feel welcome and feel like he or she is contributing. As you can see, just doing the most work will not get you the employee of the year reward. Accomplishing many other things at the same time is just as important as the amount of work you correctly and timely deliver. That is why the process of getting awarded is more like planting seeds in the field and seeing them sprout. It is not just one action; it takes many different actions to become the employee of the year. Possibly one of the most important facts at the end of the year-- do not expect that it is you that gets the award. Be humble, think of others that did also tremendous amounts of work and tried to be motivated throughout the year. Do not be disappointed if it is not you. |
